Terms and Conditions concerning the use of Second Hand Valuation Database edited on the Website
1. Subject Matter
The subject matter is a database edited on the website, produced by the IT Unit of MRA,Customs Department.
2. Copyright and Use Policy
2.1 The database and the retrieval software are protected by copyright. MRA, Customs Department holds the proprietary rights in the Product and/or is licensed to include the information in the Product.
2.2 MRA, Customs Department hereby grants the End User a non-exclusive right to use the Product for an unlimited period of time and exclusively for internal business purposes in accordance with the conditions which follow:
- The End User shall not decompile, disassemble, reverse engineer, create a derivative work, reverse translate or in any other way derive any source code from the Product.
- The End User shall not duplicate copy or otherwise reproduce the Product (in whole or in part) in any form or format.
3. Warranty and Limitation of Liability
3.1 While every effort has been made to ensure that the contents of this website are accurate and reliable, MRA,Customs Department cannot assume liability for any damages caused by inaccuracies in the database or information, or as a result of the failure of the database or software to function in a particular manner. The End User should be aware that valuation, laws & Regulations and customs procedures are subject to change and cannot be expected to remain constant. Therefore, the Product is on an "as is" basis and MRA, Customs Department. makes no guarantees, representations or warranties with respect to the Product, either express or implied, arising by law or otherwise, including but not limited to, effectiveness, completeness, accuracy or fitness for a particular purpose.
3.2 MRA, Customs Department shall not be liable in respect of any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action alleging any loss, injury or damages, direct or indirect, which may result from the End User's use of the Product or in any way relating to this agreement. MRA, Customs Department shall not be liable in any way for loss of profits or contracts, or any other consequential loss of any kind resulting from End User's use of the Product or in any way attributable to this agreement.
4. Governing Law and Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of the Republic of Mauritius.
Used Vehicle Valuation Information Disclaimer
Users should note that actual vehicle valuations and decisions on duty and taxes payable on imports of used vehicles are within the exclusive mandate of the MRA, Customs Department. MRA, Customs Department may undertake a physical examination of the vehicle prior to reaching a final decision on vehicle valuation and duty and taxes payable. MRA, Customs Department does not guarantee the accuracy or completeness of any valuation information or other data displayed, and is not liable or responsible in any way to the user or to any other person or company whatsoever for any inaccuracies, or errors in, or omission of any information
